When does a hobby become a business? (UK tax)

Lots of reselling starts as a hobby and quietly turns into something more. The question that matters for tax is when a hobby becomes a business, because that is when HMRC may want to hear from you. Here is where the line sits.

It comes down to whether you are trading

There is no single moment or magic number that flips a hobby into a business. HMRC looks at whether what you are doing counts as trading, which broadly means you are buying or making things with the aim of selling them for a profit, in an organised, repeated way.

The badges of trade

HMRC uses a set of pointers, known as the badges of trade, to judge this. You do not need all of them, it is about the overall picture:

A hobby that is really just selling your own things

If your hobby is collecting, using and occasionally selling your own belongings, that is usually not a business, even if you sell a fair amount. The key is that you owned and used the items, you did not get them to sell on.

The £1,000 signpost

A useful signpost is the £1,000 trading allowance. If your trading sales in a tax year are under £1,000, you are almost certainly still in hobby territory as far as tax is concerned, with nothing to report. Over £1,000 and you should assume you may need to register and report.

What changes when you cross the line

Once you are trading and over the allowance, you usually register for Self Assessment, keep a record of your sales and costs, and report your profit. You still have the £1,000 allowance or your real costs to deduct, and your £12,570 personal allowance, so crossing the line does not automatically mean a tax bill.

Frequently asked questions

How much can I earn from a hobby before it is taxable?

If you are trading, up to £1,000 in sales a year is covered by the trading allowance. Selling your own belongings is not taxable at all, whatever the amount.

Does selling regularly make it a business?

Regular, repeated selling for profit is one of the badges of trade, so it points towards a business, especially if you buy or make items to sell.

Is my hobby a business if I only sell my own stuff?

Normally no. Selling things you owned and used is not trading, so it stays a hobby for tax, even if you sell a lot.
